The practice of medicine is both an art and a science. A bad outcome from a procedure does not necessarily mean that the medical provider was negligent. As with all other negligence claims, the medical provider’s actions or inactions will be compared to what a competent medical provider would have reasonably done under the circumstances. This is called the standard of care. If a medical provider’s actions or inactions fall below the standard of care, then the individual medical provider and the medical facility can be liable for the injuries and damage caused by the negligence.
